These Terms are between you and Svala. By applying for or holding membership you accept them, together with the Rules of the House and the Privacy Policy. Where documents conflict, these Terms govern.
2.1 Membership is by invitation or application, and is granted at our sole discretion. Payment alone does not admit you; a person reads every application.
2.2 You must be 18 or older, apply under your real legal name, and give truthful answers.
2.3 We may decline any application without giving reasons.
3.1 Membership costs USD 999.99 per month, charged through your Apple account, renewing automatically until cancelled.
3.2 Payment is taken when you take up membership and on each renewal. Prices outside the United States are set by Apple in local currency.
3.3 Cancel anytime in your device's subscription settings. Access continues to the end of the paid period. Cancelling at least 24 hours before renewal prevents the next charge.
3.4 Refunds are handled by Apple under Apple's policies. Expulsion for breach does not entitle you to a refund: the fee purchases consideration and access, not tenure.
3.5 If a payment fails, membership lapses: the lobby and messaging lock. Resume within 30 days and you continue where you left off. After 30 days your account and its data are deleted.
3.6 Founding members hold membership without the fee, at our discretion, until revoked.
4.1 One member, one account, one device. Your keys live on that device.
4.2 You may not: share or sell access; impersonate anyone; use Svala unlawfully; harass, threaten or defraud; solicit, advertise or recruit; scrape, copy or republish the membership or its conversations; screenshot, record or export private conversations; reverse engineer, attack or circumvent the app's security; or use Svala to build a competing service.
4.3 The Rules of the House form part of these Terms.
5.1 You keep everything you write and send. We claim no ownership.
5.2 Because content is end-to-end encrypted, we cannot review it in advance. You grant us only the technical permission to store and transmit the ciphertext so it reaches its recipient.
5.3 Everything expires within 24 hours by design. Svala is not an archive and must not be used as one.
6.1 Signing in on a new device retires the old one and generates new keys. Your correspondents are told the key changed.
6.2 If you lose your device, you lose message history. That is the design, not a fault. We cannot recover it, because we never could read it.
6.3 A password reset does not touch your message keys.
7.1 We may warn, suspend, or expel for breach of these Terms or the Rules, at our discretion, with immediate effect.
7.2 You may leave at any time by deleting your account in the app; this deletes your data. Cancel your subscription separately in your store settings.
7.3 We may close Svala or any part of it. If we close it entirely while you are a paying member, we will refund the unused part of your current period through Apple where we are able to.
8.1 Svala is provided "as is". We do not warrant uninterrupted or error-free service.
8.2 To the fullest extent the law allows, our total liability to you for any claim is limited to the fees you paid in the twelve months before it arose. Nothing here excludes liability that cannot lawfully be excluded.
8.3 We are not responsible for what other members say or do. Membership is not an endorsement of any member, nor of anything they propose to you. Svala provides no financial, legal, or investment advice, and any such advice you receive from a member is theirs alone.
We may amend these Terms. Material changes are shown in the app before they take effect; continued membership is acceptance. If you do not accept, cancel and leave.
These Terms are governed by the laws of the Republic of Türkiye, and the courts of Istanbul have exclusive jurisdiction, without depriving you of mandatory protections of your country of residence.
Apple is not a party to these Terms and has no obligation to provide support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.
